Welcome to The Avian Exchange LLC (“we,” “us,” “our,” or “the Platform”). By accessing or using our website, services, or listings, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Platform.
The Avian Exchange is an online listing and connection platform for aviculturists and bird enthusiasts in the United States.
-We do not sell, broker, ship, or handle birds, nor do we participate in or oversee any transactions.
-We do not conduct background checks, health checks, or legal compliance checks on users or birds.
-The Platform functions solely as a digital space where users may view and post listings and communicate with one another.
-Users must be residents of the United States.
-Users may include breeders, hobbyists, and individuals seeking to buy or sell birds.
-Users are solely responsible for complying with all applicable laws concerning bird ownership, transport, breeding, and sales.
We perform a limited verification process to reduce spam and confirm user authenticity.
Verification Process Includes:
-Providing a valid name, email, phone number, and at least one social media profile.
-Receiving a verification code via email.
-Sending that code to The Avian Exchange’s social media page to confirm control of the provided profile.
We may also review:
-Public social media activity related to birds or aviculture.
-Posting history and engagement to confirm the account represents a real person or aviary.
Important Verification Disclaimer: Verification only confirms control of the social media account provided. It does notconstitute:
-An endorsement
-A recommendation
-A guarantee of legitimacy
-A safety or quality evaluation
-A certification of any breeder, business, listing, or bird
Users are solely responsible for:
-The accuracy of their listings
-The legality, health, welfare, and suitability of any birds they list or purchase
-All communications and arrangements made with other users
-Compliance with all local, state, and federal laws
All transactions occur outside the Platform and are strictly between the buyer and seller.
Users may not use the Platform to:
-Post false, misleading, or fraudulent content
-Violate any animal welfare or transport laws
-Harass, threaten, or abuse others
-Scrape, hack, or interfere with the Platform’s operation
-Infringe on the intellectual property rights of others
-The Platform only collects payments for optional services such as featured listings.
-All bird-related transactions occur privately between users, and the Platform assumes no responsibility for them.
-Users retain ownership of content they post but grant us a non-exclusive license to display, share, and promote it.
-Users are responsible for ensuring their content is accurate, lawful, and does not infringe on any rights.
-All Platform branding, content, and code are the intellectual property of The Avian Exchange LLC and may not be copied or reused without permission.
We may suspend, remove, or refuse service to any user at our sole discretion, including users who:
-Violate these Terms
-Provide false information
-Engage in fraudulent, harmful, or abusive behavior
-Use the Platform inappropriately
All disclaimers and limitations of liability survive any termination.
By using the Platform, you acknowledge and agree that:
-We do not verify, guarantee, or endorse any user, listing, breeder, seller, buyer, or bird.
-We are not responsible for disputes, injuries, diseases, fraud, misrepresentation, financial losses, or damages arising from interactions or transactions.
-The Platform is provided “as-is” and “as-available” without warranties of any kind.
-To the fullest extent permitted by law, we disclaim all liability for any direct, indirect, incidental, consequential, or punitive damages.
We reserve the right to update these Terms at any time. Updates will be posted with a new effective date. Continued use of the Platform constitutes acceptance of any modifications.
These Terms are governed by the laws of the United States and the State of Delaware. Any disputes will be resolved exclusively in the appropriate courts located in Delaware.
